FAHY, Circuit Judge.

After a hearing, findings of fact and conclusions of law, the District Court entered judgment in favor of Susanne Richter, plaintiff there and appellee here, declaring that she is and at all times since her birth has been a citizen of the United States. 1 The Secretary of State appeals. He urges, in the first place, that the court was without jurisdiction because section 360 of the Immigration and Nationality Act of 1952, 66 Stat. 273, 8 U.S.C. § 1503’ (1952), 8 U.S.C.A. § 1503, permits only a person within the United States, which appellee is not, to institute an action…
