MEMORANDUM AND ORDER

GILES, District Judge.

This action under the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. §§ 1001-1381, charges improper termination of plaintiff’s pension benefits. The defendants are plaintiff’s former employer, his local union, the international union and the pension plan, the Budd Company Consolidated Retirement Plan (“Retirement Plan”).
