REES, Justice.

The defendant, Purl John Rauhauser, was charged by county attorney’s information with the crime of public intoxication, second offense, in violation of § 123.46, The Code, 1977. Following the entry of his plea of not guilty, he was tried to a jury, convicted, sentenced and now appeals. We affirm.

On August 13, 1977, the defendant Rau-hauser placed a telephone call from a Fort Dodge tavern to the city police department and requested he be furnished a ride home. Two officers went to the tavern, conversed with Rauhauser, suggested that he call a cab, and then left the tavern.…
