In this action the plaintiff seeks to recover damages because of the breach of a written contract. The plaintiff’s declaration consists of one count, in the terms which follow: “The plaintiff says that the defendant on or about October 25, 1899, entered into a contract in writing with the Boston and Albany Railroad Company, a copy of which is hereto attached and marked ‘A’; that said contract was to continue in effect until August 30, 1940; that under said contract the defendant was obligated to pay Fifteen Thousand Dollars ($15,000.00) per annum for the use of a portion of the Boston and…
