Plaintiff-appellant Quinn, a former employee of defendant Country Club Soda Co., Inc. (“the Company”), sued the Company, Country Club Soda Co., Inc. Retirement Plan and Trust (“the Plan”), and certain of the Plan’s trustees, alleging violations of section 404 of the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. § 1104, and alleging subject matter jurisdiction pursuant to 29 U.S.C. § 1132. Defendants moved to dismiss for lack of subject matter jurisdiction and failure to state a claim; alternatively, they moved for summary judgment.…
