This matter is before the Court on Defendants’ Motion to Dismiss, pursuant to Rule 12(b)(2) of the Federal Rules of Civil Procedure, or in the Alternative to Transfer, pursuant to sections 1404(a) and 1406(a) of Title 28 of the United States Code. Defendants’ Motion raises issues of personal jurisdiction and venue. In the underlying lawsuit, Plaintiff Hardee’s Food Systems, Inc.
