DECISION AND ORDER

MARRERO, District Judge.

Pro se petitioner Rodolfo Rodriguez (“Rodriguez”), incarcerated at New York State’s Bare Hill Correctional Facility (“Bare Hill”), seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254. Rodriguez alleges violations of his various rights under the United States Constitution in connection with his conviction for second degree robbery. The New York County District Attorney’s Office filed an opposition on behalf of respondent John Sabou-rin, the Superintendent of Bare Hill (“Sa-bourin” or the “State”).
