MEMORANDUM AND ORDER

On October 16, 2002, Zabdiel Yara (“petitioner”) was convicted in New York State Supreme Court, Kings County, of murder in the first degree and arson in the fourth degree and sentenced to consecutive prison terms of twenty-five-years-to-life for the murder and one-and-one-third-to-four-years for the arson. The Appellate Division, Second Department, affirmed petitioner’s conviction in a decision dated November 22, 2004, People v.
