OPINION AND ORDER

FRIEDMAN, District Judge.

Pending before the court are two dispos-itive motions, plaintiffs’ Motion to Remand to the Circuit Court for Williams-burg/James City County, Virginia, and defendant’s Motion to Dismiss. After examination of the record, the court determines that the facts and legal arguments are adequately presented, and the decisional process would not be significantly aided by oral argument.
