The complainants by their bill filed herein on September 9, 1939, seek to have set up and declared an express trust in their favor to the extent of a half interest in the estate, real and personal, of which J. R. MeCallum died seized and possessed on March 8, 1938. The complainants are the next of kin and heirs at law of Mrs. Mary Pearson MeCallum (also known as Mary E. or Mamie MeCallum), the deceased wife of the said J. B.
