BERRY, Justice.

This is an appeal from a judgment of the district court modifying, after term, a prior judgment granting decree of divorce and approving a property settlement contract executed by the parties.

On October 20, 1961, plaintiff in error, hereinafter referred to as “plaintiff”, filed suit seeking divorce from defendant in error. The petition alleged marriage of the parties in 1937 and subsequent birth of three children, all minors at the time the action was brought, and prayed for decree of divorce from the defendant wife upon grounds of neglect, mental cruelty and incompatibility,…
