MEMORANDUM OPINION AND ORDER
LEON, District Judge.
Before the Court is the plaintiffs Motion for Preliminary Injunction [# 3]. On May 13, 2004, the plaintiff, Joseph A. Carabillo (“Carabillo”), former Chief Legal Officer of ULLICO, Inc., filed a complaint and a motion for temporary restraining order and preliminary injunction, requesting this Court to issue injunctive relief enrolling him in certain retirement and health bene fit plans (collectively, “the Defendants”) 1 stemming from Ms previous employment.
