HENDERSON, Circuit Judge:
The appellant, Mattie Lee Bryant, is a black woman who was indicted by a Palm Beach County, Florida, grand jury for first degree murder in 1978. Prior to trial, she moved to dismiss the indictment claiming race discrimination in the selection of grand jury venires, and race and sex discrimination in the selection of grand jury forepersons, both in violation of the Equal Protection Clause of the fourteenth amendment.
