OPINION
DIAMOND, District Judge.
A determination of claim validity and infringement was previously made by the court in this patent case and affirmed on appeal. Presently before the court is the parties’ joint request for reference of the accounting stage of this matter to a special master under Fed.R.Civ.P. 53. 1 Before such a reference can be made, however, certain outstanding issues need to be resolved.
