On January 31,1978, a federal grand jury issued a fourteen-count indictment accusing seven persons of participating in the importation and distribution of illicit drugs. Three counts of the indictment included allegations against both Juan Fidel Aleman and Rogelio Hernandez Vela. Count one asserted that Aleman, Vela, and others had conspired to import heroin, in violation of 21 U.S.C. §§ 952(a) and 963.
