This action is to test the constitutionality of act No. 21 of the General Assembly approved February 16, 1931, entitled, “An Act to Make the Office of Separate Chancery Clerk Appointive Instead of Elective, and for Other Purposes.” This issue is presented to the court by appellant having undertaken to qualify under the rules of the Democratic party as a candidate for nomination at the primary election to be held August 9, 1932, for the office of clerk of the Pulaski Chancery Court in the manner and within the time prescribed by the rules of the party.
