1. PROCEDURAL BACKGROUND

On December 4, 1997, plaintiff-appellant Supermercados Econo (“Econo”) brought an action for losses sustained against defendants Integrand Assurance Company (“Integrand”), Colonial Insurance Agency, Inc. (“Colonial”), 2 Atlantic Cold Storage, Inc. (“Atlantic”), and Ernesto Cabezas (“Cabezas”), (collectively “defendants”) pursuant to an insurance policy issued under the National Flood Insurance Act of 1986 (“NFIA”), 42 U.S.C. §§ 4001-4129.
