PHILLIPS, District Judge.
The Glover Equipment Company, defendant in error, hereinafter called Equipment Company, brought an action against the St. Louis Car Company, plaintiff in error, hereinafter called the Car Company, to recover damages for breach of a contract under which the Equipment Company agreed to manufacture and deliver to the Car Company 2,000 automobile tops on what is commonly known as the cost plus plan.
