In an action for a declaratory judgment and for other relief, defendants McKesson & Robbins and Liberty Mutual Insurance Company appeal from a judgment of the Supreme Court, Kings County, entered February 3, 1966 after a nonjury trial on submitted facts, which adjudged and declared, inter alia, that *631a certain tort claim asserted against the plaintiff O’Donnell is covered by the insurance policy issued by defendant Liberty Mutual to defendant McKesson & Robbins.
