The plaintiff in error, hereinafter called defendant, was convicted in the district court of Tulsa county on a charge of manslaughter in the first degree, and his punishment fixed at a term of 99 years in the state penitentiary.
The information is as follows:
“That Byron Kirkpatrick, the duly qualified and acting county attorney of Tulsa county, Oklahoma, who prosecutes in the name and by the authority of the state of Oklahoma, comes now into the district court for Tulsa county, state of Oklahoma, on this the 14th day of September, A.
