This matter comes before the court on Defendant United States of America’s (“United States”) motion for summary-judgment (Def. Mot. (Dkt. # 34) (sealed), (Dkt. # 37 (redacted)) and Plaintiff Gustavo Vargas Ramirez’s (“Mr. Vargas”) motion for partial summary judgment (Plf. Mot. (Dkt. # 44)).
