The defendant was convicted by a jury of a violation of section 702 of the Welfare and Institutions Code.

Appellant appeals from an order denying his motion for a new trial and from the judgment entered.

The record reveals that a motion for a new trial was made and denied on August 29, 1956. Thereafter, there was a hearing in the superior court to determine whether the appellant was a sexual psychopath within the meaning of chapter 4 of part 1 of division 6 of the Welfare and Institutions Code.
