SIRICA, District Judge.

This matter comes before the Court upon the motion of the third-party defendants, Dr. Gerber and Doctors' Hospital, to dismiss the third-party complaint of the defendant, Dr. Perkins. The plaintiffs, Mr. and Mrs. Cokas, have brought this action to recover for injuries and damages they claim to have suffered as a result of negligence on the part of the defendant. From the files and records and from the statements of counsel, it appears that on September 29, 1961, the female plaintiff, thinking herself to be pregnant, visited the office of the defendant, Dr. Perkins.
