Teresa Voit, Stephanie Voit, and Stephen Sulkowski 1 (plaintiffs) appeal a grant of partial summary judgment in favor of Allen County and the Allen County Highway Department (defendants).

FACTS AND PROCEDURAL HISTORY:

The facts material to this appeal are not in dispute and reveal that on August 6, 1989 Teresa Voit and her daughter Stephanie were traveling northbound on Adams Center Road between Moeller Road and U.S. Highway 830 in Allen County, Indiana.
