Error to a judgment of the Corporation Court of Buena Vista, rendered August 23, 1900, in an action of trespass on the case, wherein the plaintiff in error was the plaintiff, and the defendant in error was the defendant.

The plaintiff in error brought this action of trespass on the case against the defendant in error, in the Corporation Court for the city of Buena Vista, claiming damages to the amount of $1,800 for mental suffering occasioned him by the non-delivery of a telegraphic message announcing the death of his father. The declaration contains two counts. The first alleges a statutory cause of action, and the second alleges solely the violation of a common law duty, and a common law remedy.
