This is a legal malpractice action, and the plaintiff challenges the defendant attorney’s negligence in a criminal case. The allegations are set forth in detail in the Plaintiff’s complaint and the defendant’s demurrer. In short, the plaintiff was charged and convicted of a felony assault and battery on a law enforcement officer. The lawyer, defendant in the legal malpractice action, had represented Ms. Desetti on the felony charge. The plaintiff was sentenced to a mandatory minimum of six months in jail and lost her nursing license as a result of her conviction.…
