Appeal from, the First District, Madison County. This action was trie^L in November, 1869, by a jury, who returned a general verdict for Isaacs, on which the court, Warren, J., rendered judgment. Isaacs was restrained by an order of the court, in a suit in which McAndrew and another were the plaintiffs, from acting as superintendent of mines under the contract set forth in the opinion, from January 7, 1868, to September, 1868. This is an appeal from the judgment of the court below, and from the order overruling the motion for a new trial, and whatever appears in the bill of exceptions, taken at the trial and allowed by the court, is properly before us for consideration and decision.
