This matter is before the Court upon a petition seeking judicial review of an administrative order. The Petition was initiated in the Chancery Court of Davidson County, Tennessee, wherein the appellants challenged the jurisdiction of the Tennessee Department of Labor, Division of Occupational Safety and Health (“TOSHA”) to conduct safety inspections concerning pesticide applicators (i.e., persons who apply pesticides) and to enforce such regulations.
