This is an appeal from an order of the District Court granting a preliminary injunction against the city of Kansas City, Mo., the defendant in the court below, restraining it from the use of two pneumatic flushing machines purchased from the Studebaker Corporation, and alleged to be an infringement of patent No. 795,059, granted to Ottofy July IS, 1905.
