In this action plaintiff seeks to recover for personal injuries sustained by him by reason of a defect in a public way.

There was evidence that on January 27, 1968 at about 11:00 A.M. the plaintiff was walking on the sidewalk near the Williams School; that there was a rise in said sidewalk; that said rise was located about three feet from the alleyway which allegedly runs parallel to East Berkeley Street.
