STEPHENS, Associate Justice.
This suit was instituted by the county attorney of Ellis County, in the name of the State, under title 36 of the Revised Statutes on the subject of escheat. It resulted in a judgment in behalf of the State against appellant for lots 5 and 6 in block 14 in the town of Waxahackie, Ellis County, from, which judgment this appeal is prosecuted.
In the year 1862, one Thomas Stephens died seized of these lots, without disposing of them by will and without heirs. In 1865 appellant took actual possession of the lots, claiming them as his own, and made permanent and valuable…
