1 1 Plaintiff, Tim Hutson, appeals an order of the trial court granting a new trial to Defendant, Koteswar Rao Sureddi (Dr. Sur-eddi). The two issues on appeal in this medical malpractice action are whether the trial court abused its discretion in (1) granting a new trial to Dr. Sureddi, and (2) refusing to grant a new trial as to all parties and all issues. We find that the trial court did not abuse its discretion in granting a new trial as to Dr. Sureddi, but did abuse its discretion in refusing to grant a new trial as to all parties and all issues.
