The plaintiff, a judgment creditor, caused the arrest on mesne process of his debtor, one Magurn, on November 22, 1922, who “ on the same day recognized with surety that within thirty days from the date of his arrest he would deliver himself up for examination before a Police, District or Municipal Court, or a Trial Justice, giving notice of the time and place thereof as provided by law and appear at the time fixed for his examination and from time to time until the same is concluded, and not depart…
