1Opinion of the CourtBayless, J.
Israel Lewis, a full blood Choctaw Indian, died intestate at the approximate age of 85 years, a resident of Pontotoc county, possessed of certain real estate therein, the same being a portion of his allotment and restricted lands. After the death of his wife and son, he and Ada Alford, a Negro woman, made their home together for about 25 years until his death on September 18, 1945. In his later years he was physically incapacitated, and testimony tends to show that his mental condition was weakened.
