This was an action of assumpsit, brought by Elizabeth Kielgast, administratrix of the estate of Otto Wilhelm Kielgast, deceased, against the United States Life Insuiance Company in the City of Mew York, to recover the amount of a policy of insurance'on the life of the plaintiff’s intestate. The policy was dated July 22, 1884, and contained, among other things, a condition that if within three years of said date the insured should die by self-destruction, whether voluntary or involuntary, whether sane or insane, the contract of insurance should become null and void.
