Presently before the court in the above-captioned action is the motion (Doc. 24) pursuant to Federal Rule of Civil Procedure 56(a) filed by defendant Subway (“Subway”). Subway seeks summary judgment with respect to all claims asserted by plaintiff Kiera Barber (“Barber”), a former employee, who alleges that Subway discriminated against her as a result of her disability, failed to accommodate her disability, and retaliated against her for requesting an accommodation, in violation of the Americans with Disabilities Act (“ADA”), 42 U.S.C. § 12101 et…
