MURRAY, Chief Justice.

This suit was instituted by Howard Chandler against San Antonio Portland Cement Company seeking to recover damages for personal injuries received on August 28, 1958, as a result of being bumped off a crane rail beam by a crane belonging to the Cement Company, while working as an iron worker for G. W. Mitchell Construction Company, an independent contractor, hereinafter called Mitchell, which was doing iron work at the Cement Company’s plant.
