MEMORANDUM OPINION
WOODWARD, District Judge.
The plaintiff in this suit is a former teacher employed by the Borger Independent School District who last taught in that system in the 1969-1970 school year but his contract to teach in 1970-1971 was not renewed. The defendants are the superintendent of schools in his official capacity, the Borger Independent School District and the Board of Trustees of the Borger Independent School District in their official capacities.
