This matter is before the court on defendant CSX Transportation Company’s motion for summary judgment filed on November 16, 1988. In this motion, CSX Transportation Company notes that, at the time the court entered its order and accompanying memorandum opinion of November 10, 1988, refusing to dismiss plaintiff Daniel L.
