Appeal from an order of the County Court of Broome County (Smith, J.), entered June 16, 2000, which, inter alia, denied defendant’s motion pursuant to CPL 440.30 (1-a) for the performance of forensic DNA testing on specified evidence.
In 1995, defendant was tried and convicted of the crimes of rape in the first degree (two counts) and sodomy in the first degree for which he was sentenced as a second violent felony offender to three concurrent prison terms of 10 to 20 years.
