ORDER GRANTING IN PART AND DENYING IN PART MOTION FOR CLASS CERTIFICATION

I. INTRODUCTION

This matter comes before the Court on a motion for class certification filed by plaintiff Kavu, Inc. (“Kavu”). (Dkt. #23). Plaintiff alleges that defendant Omnipak Corporation (“Omnipak”) sent it an unsolicited advertisement via facsimile in violation of federal and *645Washington law. Plaintiff seeks to represent a class of people who received the same facsimile. At defendant’s request, the Court heard oral argument in this matter on January 23, 2007.
