The record in this case discloses that Edward Siegal, plaintiff in error, sued the Portage Yellow Cab Company, defendant in error, to recover damages for personal injuries which plaintiff claimed to have suffered by being run into by a taxicab of the defendant while crossing a street at an intersection. The accident occurred about 11 o’clock at night, when there were no passing street cars or other vehicles on the street except the one causing the accident, and when the street intersection was well lighted.
