1. The ruling in the headnote on the motion to dismiss the *791bill of exceptions needs no amplification. The brief of evidence, it is true, contains approximately two pages of questions and answers, out of a total of nearly fourteen pages appearing in the record in this court, but- it is obvious that a bona fide effort was made by counsel for the plaintiff in error to reduce the testimony to narrative form; and their opinion that the inclusion of certain questions and answers, without abbreviation or "condensation, was essential to the presentation…
