Servewell Plumbing, LLC appeals the dismissal of its claim against Federal Insurance Company as surety on a labor and material payment bond issued to Summit Contractors, Inc. The district court 1 dismissed the claim for improper venue based on a forum selection clause in the contract between Summit and Servewell, which required any claim against Summit or Federal, as Summit’s bonding company, to be brought in Duval County, Florida.
