MEMORANDUM OPINION AND ORDER
ARRAJ, Chief Judge.
I. Background
The individual plaintiff, Samuel Taylor, brings this claim for relief under Title VII of the 1964 Civil Rights Act, 42 U.S.C. § 2000e et seq. (1970), on behalf of himself and those similarly situated. Our first opinion in this case, 333 F.Supp. 83 (D.Colo.1971), denied the defendant’s motion to dismiss the class action and ordered the suit maintained pursuant to F.R.Civ.P. 23.
