We granted certiorari in People v. Gallegos, 926 P.2d 156 (Colo.App.1996), to review the judgment of the court of appeals reversing the second-degree murder conviction of the respondent, Eric Gallegos. 1 The trial court dismissed two of the three counts against Gallegos at the preliminary hearing for lack of probable cause. The prosecution appealed the dismissal, but eventually chose to withdraw its appeal.
