This is an action of boundary brought under Articles 823 and 824 of the Civil Code. The plaintiff alleged that he owned a certain tract of land in the Parish of Natchitoches which is bounded on the east by a tract owned by the defendant, G. Percy Smith, and that *508the boundary line between the two tracts is unknown and unmarked; that he had been unable to obtain defendant’s consent to have said boundary line established; and he prayed that the Court appoint a surveyor to establish the line according to the methods prescribed by the Code.
