The plaintiff alleges in substance, that he is the owner of a tract of land of 400 acres, situated in prairie Mer Rouge, parish of Morehouse, which is contiguous to a tract of land claimed by the defendant; that the defendant, although requested to have the boundary dividing said tract fixed in accordance with their respective titles, has refused to do so, and has, moreover, actually encroached upon the plaintiff’s land by the enclosure of forty acres thereof.
