Frank W. Thomas filed in the Superior Court of Wilkes County a petition in which he alleged that he was the duly qualified and acting trustee under the will of Ethel A. Toombs; that Louise Toombs Reynolds and T. Willingham Wood were the life beneficiary and remainder-man respectively under said trust; that, because of his health, trustee could no longer discharge his duties as trustee, and he prayed that he be permitted to resign and that a successor trustee be appointed.
