Appeal from a judgment of the Supreme Court (Teresi, J.), rendered May 22, 2003 in Albany County, upon a verdict convicting defendant of the crime of criminal sale of a *691controlled substance in the third degree and of the violation of unlawful possession of marihuana.

The evidence supports the jury’s verdict that defendant was an accomplice in the sale of heroin to a confidential informant.
